BEING A BY-LAW TO REGULATE THE KEEPING OF CATS

WHEREAS Section 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, enables municipalities to govern their affairs as they consider appropriate and to enhance their ability to respond to municipal issues; and

WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, C25, as amended, enables a single –tier municipality to pass by-laws respecting animals, being a matter within the spheres of jurisdiction; and

WHEREAS the Council deems it expedient to adopt a by-law to regulate the keeping of cats;

NOW THEREFORE the Council of The Corporation of the Municipality of Red Lake HEREBY ENACTS AS FOLLOWS:

1. Definitions

1.1 “Cat” means a male or female animal of the feline family that has been domesticated and is over the age of twelve (12) weeks.

1.2 “Dwelling” means any building or structure for human habitation including duplexes, apartments and other buildings housing one or more families.

2. Keeping of Cats

2.1 No person shall harbour, keep, have in his/her possession or on his/her premises more than three (3) cats over the age of six months, regardless of the number of people who may be inhabiting the premises.

3. Enforcement

3.1 Every person who contravenes any provision of this by-law is guilty of an offence and on conviction is liable to a fine as provided for in the Provincial Offences Act. The set fine is set out in Schedule “A” attached hereto and forming a part of this By-Law.

4. Enactment

4.1 That By-Law No. 193-02 is herby repealed.

4.2 That this By-Law shall come into force and take effect upon the final passing hereof.
